Is it illegal to take someones Youtube video, change it, and re post it?

I want to make fun of someones Youtube video by altering it with Adobe Premiere and combining it with a commercial i saw on TV. Is this illegal in CA? or anywhere?Is it illegal to take someones Youtube video, change it, and re post it?%26quot;CA%26quot;, as in Canada? Or California?



In the US you can use copyrighted material to create a %26quot;parody%26quot;, and its perfectly legal and protected as free speech under the 1st amendment in the Bill of Rights. However, this fact usually does not stop the owner of the original content from trying to get it taken down, via a DMCA take-down notice. Youtube usually just yanks these video's off their site once they receive a take-down notice, rather than do any research or even contacting the uploader prior to the removal, but you do have a right to do this under the US Constitution, despite what the original content owner says.



You can file a counter claim and get the video put back on Youtube, and then sue the original content owner for abuse of the DMCA take-down notice system, but the penalties for abusing the take-down system are laughable, and you will be spending good money on legal fees for very little return, other than to make a point about your rights.Is it illegal to take someones Youtube video, change it, and re post it?That would be considered a parody, which is fair use under US law. This is because as of 1978, every work that someone makes is automatically copyrighted without the need for any sort of permission. This means that no one can duplicate, edit, or use a person's works unless they have permission. You could always ask them if you could use it and tell them what you're going to do... there's always a chance they will let you. My one friend did it and he got lot of fines and internet shut off and in court for it. DON'T DO IT!
